DEADLINES AND RUSH FEES
1.Standard Deadlines
Artwork delivered between 3 to 8 weeks, depending of the complexity of the piece.2.Rush Fees
In cases where a client requires a project to be completed before the standard delivery time, a rush fee will apply.This fee is typically 20-40% of the total project cost, depending on the urgency and scope of the work required. The rush fee will be inform upon before starting the project.
PAYMENT TERMS
Initial Deposit: 50% down payment (for sketch commissions, 100% payment)
Final Deposit: Remaining Amount (due upon completion of the artwork)Payment methods accepted via Stripe payment link or Wise transfer.
RIGHTS AND USAGE
1, Artist's Rights:
Unless upon written agreement, Blue Birdie retains the intellectual property of the commissioned artwork.The Artist retains the right to use images of the artwork for their portfolio, website, social media, and other promotional uses.
2. Client's Rights:
The Client is granted a non-exclusive, perpetual license to use the artwork for personal use.
For commercial use, additional terms and fees apply (see below).3 Commercial Use:
I. Definition of Commercial Use:
Commercial use includes any use of the artwork for business purposes, such as marketing,
advertising, posters, prints, merchandise, etc.II. Commercial Use Fee:
An additional fee of 80% of the value of personal use commission will be charged for the right to use the artwork commercially.4. The following is considered copyright infringement:
Removing the Artist’s signature. Altering the artwork without the Artist's consent. Selling it as NFTs. Using the Artwork to feed, train, or otherwise further machine learning algorithms, AI, or similar software.
CANCELLATION AND REFUND POLICY
1. Cancellation by Client:
100% refunds are possible only before the Artist begins working on any part of the artwork, including sketches.If the canceling occurs during the process of the artwork, the Client agrees to pay a proportional amount of the hours invested on the artwork.2. Cancellation by Artist:If the Artist cancels the project, any payments made by the Client, including the initial deposit, will be refunded in full.
